    I recently suggested a client utilize another tax preparer. This was a complex return with many K-1's, suspended losses, basis limitations, multiple states, etc., etc.

    Former client has apparently found another preparer who uses Lacerte as we do and is asking if I would provide a copy of our Lacerte file. Not sure if I have to do this or should do this. Also if yes, should I provide 2017 file or rolled over 2018 file. I would think I would want to provide 2018 rather than 2017. Any thoughts would be appreciated. This would save new preparer considerable time I am sure.

    I have been in this situation quite a few times.

    Each time, I was denied the electronic file. I never understood why.

     

    Law says we must give information if requested.  It does not state what form it should take.  Granted your client has the information to present to his new preparer

     

    However, with that said, I would think and say     WHY NOT give it.  Where is the liability in extending our self for others. How could it put you more at risk.

    I do not think anything is more apparent in giving the electronic file, than is apparent by giving paper., and you have taken the high road.

     

    It is what I would want others to do for me.

     

    Of course, this is only my humble opinion

    I'd see no reason not to provide the 2018 file. 2017 might include combinations and adjustments that I care not to share or explain

    There is no legal requirement to provide the data file, just the tax return and original workpapers retained, but it is just common professional courtesy to provide the data file. We sometimes prefer not getting the file and often times do not request it depending on the client because we also often times find mistakes on the prior-year returns which may or may not be overlooked when just importing the prior accountant datafile. The tendency might be just to accept the numbers from the prior accountant.
