I have a new client that was established as an LLC but the prior accountant elected to be taxed as an S Corp.

Can anyone tell me if the LLC is still required to file the annual report and remit the minimum fee?

If not, should the entity then be filing the bi-ennial statement?

I know when the above election s made, from a legal standpoint, it is still an LLC so I am thinking the annual report is still required.

As always, I appreciate the assistance of the group.

    Vincent:

The answer is no on the annual filing fee return and yes on the biennial statement.
