Many of us have experienced issues with out of state sales taxes for our customers – especially post Wayfair.  I know that we have all been told that we can easily look up the sales tax filing requirements for each state, but these requirements can be onerous, especially when our clients don't always communicate needed information with us on a timely basis.

Please send us your war stories.  It does not matter if it is something you heard about from a friend or colleague of if it is something you have experienced yourself.  Getting this information out to our members will help us all do a better job for our clients.

Make sure to "Recommend" the story that you think is the best. The story with the most recommends will be the winner!

To recommend a story, just click on the "Recommend" button in the upper right-hand corner of the page (see below).

    HI
Is the any association(AICPA, NATP, NSA, etc)  or group that can give or had a listing for each states'  sales tax filing requirement and
if a certain amount of business is sent to a particular state,  if there are any other filing requirements, With all the dues we pay to
these groups, they should have this information available for us as we could be facing major problems with our clients about
    the sales tax filings.

    James:

The requirements are still evolving and it is an onerous task for any organization to provide that.

I do have the tools in my office to do it. That subscription costs me 3 times what I pay in dues to all the organizations I belong to combined.

And even those expensive tools often send you hunting for more info on definitions per state of digital (products, access), online / cloud (information, hosting, software, etc), remote services, etc.  And then those definitions change, and then they change again.  Adding to the fun, I came across the attached article in the Journal of Accountancy yesterday about responsible persons post Wayfair.  So far I've only scanned it quickly, but it looks like something else to keep in mind (especially for those who do CFO outsourcing work).

    James,
You may want to consider contacting Brian Gordon of State Tax Audit Representation (516-510-6041) or Mark Stone of Sales Tax Defense (631-491-1500).  Both specialize in sales tax matters and may be better able to provide information regarding this issue.  The only other alternative is to visit the websites of the various states to determine what their criteria are in this post Wayfair era.
