    What is my  obligation  to file  a tax return if the client doesn't return the efile consent form?

    Technically     you are not allowed to file.  You have not been authorized..

     

    Which equals   =  judgement call

    When you say "technically you can file without their permission", is this based on actual regulations or practical application?

    If it is the former, then I have wasted a lot of time the past few years with spreadsheets that track mailing, receipt, filing and acceptance of tax returns.  I also told (and eventually trained) clients that I absolutely can't file their returns without returned e-file authorization forms because their signature on this form takes the place of their signature on the old paper filed tax returns.  And of course, should something go wrong, and I don't have a signed form in the file, it would not be a good situation to have a client question why I filed their return without proper authorization, regardless of what they tell me by alternative methods.  Finally, I have heard from a few accountants of IRS and NYS audits of e-file authorization forms that focus on timely filing once an authorization form is received (and only after it is received).

    I understand that as a filing deadline occurs and we are up against the clock, there may be an exception or 2 made in order to get a return filed on time.  But that is the rare exception, and not the rule.

    I am not asking what is done. Specifically I am asking if we have met the standard if I receive an Emil,  asking me to file, and stating that they are not near a fax or scanner.

     

    Granted,  it is considerable different than just filing with out any back up for your file, but have we met the standard?

     

    I would think not.
