LEARINING OBJECTIVE: Due to the COVID-19 pandemic, there has been widespread telecommuting and sheltering in place, either at home or at another residence. This seminar will discuss resident and nexus determinations under Federal and State law and how such determinations may be impacted by the pandemic. We will Consider:
- Is my company establishing nexus in a new state by directing/allowing my employees to work from home?
- Which state do I withhold income tax from when these employees are working from home?
- NYS statutory residency and domicile considerations
- Difference between IRS and NYS individual resident determinations
- Resident day count determinations and exempt days.
