I do not believe that there usually is a problem if you are forming "Tom Dick and Harry Corp." in New York even though the same name may exist for an active corporation in either New Jersey or Texas. Subject: Naming a Company - Checking Availability Nationwide
Happy almost tax season everyone. Was wondering if any of you know of any national databases for checking name availabilities when forming a new entity. I have come across a few scenarios where the name will be available with the state but not with IRS as another state has it in use or too close to another that it causes a naming conflict and hence rejects the EIN application. Instead of checking each state's Dept of State's website, is there a nationwide database a quick search can be done in or do some of you have a process you use? I have typically always legally formed it then obtained the EIN but I guess maybe flip flopping it would be the better way to go as it is easier to check with your own state of formation than nationwide.
