  • 1.  New Client - Former CPA is not complying or furnishing records

    Posted 01-03-2024 02:15 PM

    Hey All,

I got a new client recently since the prior CPA is not responding to any inquiries, hasn't filed several years of returns, and is ignoring any phone calls from the client and will not furnish records despite being paid monthly. Is there any legal action the client can take for refusing to return any calls or anything and furnishing proper documents? The client has called daily for weeks and cannot get a call back and now the receptionist doesn't pick up the call - I also tried to call and speak to the CPA myself and also was told to leave a message. The client is a C Corp with a fiscal year with a due date to file Jan 15th so the client is very very concerned.

Please advise on what you guys recommend we do or who to call for advice.

    Best,

    Matt

    Hi Matt,

Your new client can ask his attorney to send a letter (certified mail, return receipt requested) asking for the documents.  I have found that a letter from an attorney works sometimes.
