Answer from Steve Carbone of the Long Island district office of the Workers Compensation Board:
"
If an existing company never had a DBL policy, and now wants to get one,
would it would get questioned by the state as to why it didn't have one before? No easy answer to this one. It depends on if they were in the Board's system and the status of that employer in the system. Also, how long would an employee (co-owner) need to wait prior to filing a claim? If they are a Partnership with no employees, the partners may not voluntarily cover themselves for NYS disability insurance. If a partnership has employees, the partners, themselves, are automatically excluded from the business' disability benefits insurance coverage and cannot be included. For more information, please see page 116 of the Employers' Handbook at the following URL: http://www.wcb.ny.gov/content/main/Employers/EmployerHandbook.pdf"
Thank you Steve!

Anyone have any experience with this?
Also, how long would an employee (co-owner) need to wait prior to filing a claim?
