  • 1.  Dispute with a Client Over Tax Due

    Posted 04-18-2016 01:13 PM
    Hi all,

I am looking for some advice on how to handle a dispute with a client.

The client has a sole proprietorship. I prepared his 1040 with schedule C. When I informed him for the 20 th time that he owes a lot of tax, he tried to pressure me into taking deductions that he was clearly not entitled to and that he had no justifiable reason for taking. I continued to refuse and he continued to pressure me. I finally left his shop, and in the heat of anger, I left the copies of the tax returns that I prepared on his table. He did not sign the authorizations, and I have no intention to file his returns.

    Questions:

Should I file an extension for him, and if so do, what liability should I put down?

Am I obligated to file the extension? I would prefer to do nothing, but I don't want to expose myself legally.

    Thank you!

    firstly,

i would never file something i am uncomfortable with   never.

typically when we have been retained, we issue a form of " discontinuance of services"..

but in your case, how could you file a return for which you are not in possession of signed E file Auth   ?

and to me.,   he has just refused your services.

i also suggest you call your E & O carrier for advice  if you are concerned about push back from this..

I agree with Abby. You should contact your professional liability carrier and put them on notice.
