  • 1.  NYS Corp. minimum tax

    Has NYS eliminated the $800 minimum tax for inactive corporations under 9A?  It was prevalent when we had the 3 factor formula, but since the State went to calculate tax allocation based on sales, has the $800 inactive corporation tax been dropped?  It is still in the law, but it is not in the directions for the minimum tax calculations.  I asked that because I have a client who started a corporation and then did nothing.

    I believe that it is now tied to the revenue amounts.
    if you have zero - the tax is $ 25
    if you have one million dollars of revenue - and one million dollars of expense - it is $ 500
    etc

    I have not consulted the law, but I can tell you from experience, I have filed many of these inactive, and never been assessed, at least not in recent years.....l
    lets see if others chime in.
