    A client's year 2012 NYS personal income tax return was e-filed 4/4/2013 and accepted by NYS on 4/5/2013.

    The NYS Department of Taxation & Finance has withheld my client's refund due to the fact the a paper W-2 was not separately received by the tax department.

    Has anyone encountered this issue since I find it strange to require a paper W-2 especially since employer payroll tax returns are now electronically filed and the Department of Taxation already has electronically received the W-2 information?

    Advice?

    You mean NYS is finally catching up to Pennsylvania (lol)?  Pennsylvania has been using this method to delay refunds for at least 2 years.

    You know I am no friend of NYS, but who handled the payroll?  If the information was not properly submitted with the NYS-45, that would screw up things.

    That Is my feeling exactly. I am under the impression that there is nothing else to be done in compliance as a usual course of business. 

    Unless chime in here, I am going to drop the issue, and regard this as an isolated event.    but you're right, seems there is something else going on here.

    I am most interested in the outcome.  This answer affects all practitioners.

    Have you resolved the question of what are our filing requirements ?

    Is NY expecting our e filed returns to be accompanied by something in paper ?

    Is their response saying that the employer never filed the year end forms?

    Your post is too important to not be supported and completed.

    In response to Abby's comment, generally NY does NOT require paper W-2's for efiled returns, only paper returns.  However, as a way to delay processing refunds, they have been known to ask for paper copies.
