    Good morning,

    A client of ours, a NYS corporation, purchased used equipment from a Canadian company. He then hired a Canadian trucking company to deliver the equipment to his place of business on LI. The equipment will be repaired, repainted and resold to the the general public as used equipment. All NYS sales taxes will be collected from the ultimate customers upon the retail sale in NYS and remitted when he files his sales tax returns.
    The issue is that the Canadian trucking company is charging him Canadian Sales Tax. Does he have to pay?

    Hi Mary,
    The fact that your client takes possession in Canada by hiring a trucking company makes him liable for the Canadian taxes.  Your client must take possession outside of Canada to be exempt.
