    Hi,

    I hope everyone and their families are well!

    One of our clients has become pregnant with her 2nd child. There are complications to her pregnancy that require her to be on bed rest. She had been a full time mom. Her filing status is mfj. The husband is working full-time as a nyc firefighter. They enrolled the first child in daycare. Can she take a tax deduction for child care expenses?

    I believe that both spouses must be working to get the child care credit

    I agree, both spouses must be working. Has your client asked id a flex spending or other benefit plan is available

    "For each month or part of a month your spouse was a student or was disabled, he or she is considered to have worked and earned income"

    sounds to me like she was disabled - even though just temporarily - you have have a case for claiming the childcare credit
