  • 1.  NYS LLC to Sub-S

    This question is regarding a single member LLC filing as a " C" for many past years.
    I know that if I file a 2553 I can elect to be treated as an 1120S in the future.
    However, what about NYS?  Can a CT-6 be filed for the same treatment in NY?  The CT-6 instructions make a requirement for NYS election that the entity must be a Corporation.  For this purpose, does an LLC qualify for CT-6 election?

    Yes you can elect NYS sub S as well. Company remains LLC as far as everything but income tax treatment, which is now a Sub S. Done it many times over the years.
