Taxpayer passed away June 2020. Extensions were filed 7/15/20 for 2019 tax returns. His son is the executor of his estate and is still waiting for Letters Testamentary to be issued by the court. He was told by the estate attorney it will be another 4 - 6 weeks due to slowdowns caused by Covid-19. Is there any way we can file these returns by October 15th? There shouldn't be any penalties if they are late as there is a refund due.

yes--attach a note to the tax return and form 56 explaining Covid-19 and the attempts you made to secure these letters and they will be supplied as soon as they become available.
