  • 1.  Amending a joint return when 1 spouse will not sign

    My new client Filed a joint return. The taxpayer neglected to include 1099 income/self employment income Approx 100k. The IRS recomputed his return for this additional income. We need to file an amended return with  a schedule C and claim expenses to reduce the amount assessed. The Spouse will not sign the amended return. Looking for advice on how to move forward.

    Have the spouse sign an "innocent spouse" document 
    i assume the reason for not signing is not to be responsible for the error nor the tax due

    Try form 8857 and see if that applies your situation--good luck
