Beginning in 2012 the Department of Labor expanded the required disclosures to plan participants focusing around plan expenses charged to participant's accounts. The Supreme Court, in a recent decision, has made it clear that it is also the responsibility of the plan sponsor, i.e. the employer, to monitor all investment alternatives available to participants. This is an ongoing responsibility that exposes fiduciaries to personal liability in the absence of compliance. This session will review the specifics of compliance and several other fiduciary issues unique to 401(k)/403(b) plans.
