Misclassification of employees occurs when an employee is incorrectly labeled an independent contractor or is "off-the-books." Because of increased governmental scrutiny of employers who classify workers as independent contractors, it is essential for employers to determine if their workers are properly classified. How this is done and what are the latest considerations made by federal and state agencies will be closely examined. The DOL's proposed increase of the salary threshold for white collar exemptions will also be covered. Finally, we will review a significant recent court decision which involves a new test for determining whether interns must be paid just like regular employees.
