NY Individual Extensions

    Does NY follow the Federal rule that if you don't have 80% paid in that the extension may be disallowed?  In other words, will NY disallow an extension that was filed with zero due when the return ultimately had a balance due that was more than 30% of the total NY tax liability?

    ​Hi,

    In order for an extension to be valid, three criteria must be met:
    1. filed by the due date
    2. 90% of the current years liability must be paid on account by the due date or
    3. 100% of the prior years liability must be paid on account by the due date.

    If not met and the return is filed after the due date, a late filing penalty can apply

    You've indicated that 3 criteria need to be met, but at the end of #2, you put or.  Is it all 3 or is it 1 plus 2 or 3?  Thank you for your assistance.  ​
